
In accordance with paragraph 1.4.2.1 of ADR 2013, the shipper is responsible for the packaging and labeling of goods it sends and may not delegate duties to third parties, such as the carrier.
Either the container or the packaging are working tools and, according to the legislation on labor protection, suitable material should be given to workers by the person in charge (section 3.1 of Spanish RD 1215/1997) as well as protection against infectious substances (art. 6 of Spanish RD 664/97).
Labeling is what defines, from outside, the type of goods and their danger so that in case of accident, it would be possible to act accordingly. Improper labeling means taking unnecessary risks or giving wrong information, as well as breaking the legislation and assuming the sanctions due to proceeding in this way.
